I have seen many 'repurposed', 'upcycled' items( keychains, hats, etc.) on here, and started considering how to do it myself with damaged or old Louis Vuitton bags but wanted to know the legal restrictions. I came to understand that many of these ' upcycled' goods are actually infringing on brands' copyrights/trademarks. I thought I would share, since I'm sure many sellers are unaware they are engaging in this behavior.

jonchrisprice I listed some upcycled keychains and they removed by Posh. I had no idea this wasn't allowed since there are so many of them listed.

allissat
allissat @jonchrisprice I was debating making keychains or jewelry, since I see really cute stuff like that on here all the time, but I remembered reading something in passing about an etsy getting closed for repurposed items and so I wanted to know the rules! I definitely think people just don't realize it like we didn't!

lindsey_weems
lindsey_weems Some people use fake goods to re-purpose so you really are not even purchasing a true up cycled good. Unless it comes with authentication documentation- I would stay away.

adele121608 have to share their amazing both quality & appearance. Each has unique style individualized to customer’s taste. received the first one and immediately requested a second! Seller is extremely trustworthy honest, up to date on fashion trends. She spends much time as needed until client gets the bag and color scheme they want. Seriously 5⭐️quality/customer service. I cannot wait for my next bag. And the compliments, I won’t lie, who doesn’t like being asked about their 👛.

ohseedeez
ohseedeez This is good information to know. Respectfully, like all legal writings, your message would be more impactful without so many punctuation errors. I'm happy to edit it for you if you like.
Feb 14Reply
allissat
allissat @ohseedeez It was just a quick notice that I did on my phone. You're more than welcome to edit/ share, and I would update my listing if you're okay with me using your images.
Feb 14Reply
ohseedeez
ohseedeez @allissat I don't have any idea what you're talking about "my images." Please explain.
Feb 14Reply
allissat
allissat @ohseedeez I figured you would type it up with the edits and upload to posh. I wouldn't want to screenshot your listing images without your permission.

visualcloset
visualcloset How is painting on a bag illegal, or not illegal?
Mar 02Reply
annettesoto55
annettesoto55 @cptl62 I also agree.
Mar 02Reply
allissat
allissat @visualcloset painting on a bag isn't illegal, unless you're painting another artist's copyrighted work. The illegal products I've seen are those ' repurposed' keychains, hats, etc. being sold under the 'Louis Vuitton' brand.

inuyasha18 @allissat This is great news! What about the LV purses with the images stitched outside and relining inside?
Mar 02Reply
sand_98
sand_98 @allissat so quick question, are you suggesting people that do this to just list it under “keychain” or accessories and not affiliate it under the actual brand name?

aliciawoodson
aliciawoodson Put this like “keep it Gypsy” does and you should be legal. Since some of the LV print has the actual trademark on it that is why it is legally an infringement but disclose it isn’t an LV item and you won’t have any issues.
Jun 06Reply
aliciawoodson

Jun 06Reply
allissat
allissat @sand_98 yes. if they are reselling an item made by boho bags or any other company, the brand name in the listing should be whatever company made the new product. if the seller is the maker, then it should be sold without a brand on the listing.
Jun 06Reply
allissat
allissat @aliciawoodson they sell their products on their sites, but anyone reselling items from them should put 'gypsy' as the brand, not Louis Vuitton.
Jun 06Reply
allissat
allissat @aliciawoodson I'm not selling anything thats infringing on trademarks, but if anyone does sell a product in a different form than originally sold, they would have to list it with a disclaimer like that and sell it without 'Louis Vuitton' as the brand

moonthreads
moonthreads thankyou for making this! sooo many people do not understand that its illegal.its against poshmarks rules to sell or buy these, YET poshmark is "authenticating" these bags! so if poshmark knows its illegal but they are allowing the sales they are knowingly breaking the law. if you have any respect for these brands you wouldnt be selling these. it isnt illegal to upcycle your own bag for personal use( or thats my understanding)
Nov 28Reply
moonthreads
moonthreads @adele121608 who are you talking about in your comment?
Nov 28Reply
moonthreads
moonthreads @aliciawoodson actually no, they are breaking the law and lv has sent hundreds of "cease and desist" letters to hundreds of "brands" who do this.you have to have permission from the brand to sell these items.
Nov 28Reply
allissat
allissat @moonthreads you can upcycle and customize the bags, the issue is when you're changing the essential product- using materials from authentic bags to make keychains, necklaces, hats.
Nov 28Reply
moonthreads
moonthreads @allissat do a search of Louis vuitton+ leatherandvodka + cease and desist. they explain it so much better than i can about how it is not legal and the steps LV has taken to stop it
Nov 28Reply
allissat
allissat @moonthreads yeah, the attorney quoted in that article is saying exactly what I am.. .Upcycling is protected under 'fair use'- stuff like adding fringe, custom paint, etc. However- if you add protected property to a different product that is illegal. Customized products( bags/shoes) = totally legal- Using protected( trademarked) products( bags) in a different form/ product(keychains/hats)= illegal.
Nov 28Reply
allissat
allissat @moonthreads  "According to attorney Andrea Sager, “Upcycling is typically fair use. However, upcycling companies are on a VERY fine line. When companies, cut up a used designer handbag and add that material to a different product, even if it’s a product from the same designer, that is crossing the line. Adding fringe and your own touch to a product is fair use. It’s considered art and not illegal. However, if you want to add a protected logo to a different product, that is illegal "
Nov 28Reply
petiteshopper
petiteshopper @allissat I'm a little confused of how "fair use " is used w/out getting into trouble vs "add protected property to a different products is illegal"
Dec 09Reply
allissat
allissat @petiteshopper So, I am not a lawyer...so dont try to quote me in court lol...BUT.. essentially if you take a bag and paint it, or add studs( whatever) your work is considered art( which has its own protections); and you're not altering the essential product so it's ok.
Dec 09Reply
petiteshopper
petiteshopper @allissat interesting... but making watch bands, key fobs would be considered illegal?!
Dec 09Reply
allissat
allissat @petiteshopper However, it is illegal if you take a bag, cut it up and turn it into keychains( or book covers or whatever). Essentially..the protected product is the BAG( not just the company emblem)... and using pieces of it as part of another product voids the authenticity. Then you are using trademarked property( company logos) without permission.
Dec 09Reply
petiteshopper
petiteshopper @allissat got it! How are there are so many IG accounts selling repurpose accessories and jewelry.. how do they do it?! Blows my mind
Dec 09Reply
allissat
allissat @petiteshopper The same way you couldn't paint 'LV' emblems on cheap sneakers and try to sell them since they would be using trademarks without permission, you can't use pieces of authentic products. Bottom line, the laws are weird sometimes.
Dec 09Reply
petiteshopper
petiteshopper @allissat I really appreciate this info. I have a better understanding. Thank you so much!😊
Dec 09Reply
allissat
allissat @petiteshopper yes, those are all illegal! Honestly, a lot of those sellers are pretty recent and weren't on big brands' radar but the past year they have( at least LV has) really started going after them. They start with cease and desist orders, and most people stop. I know of 2 sellers on Posh that recieved letters, so it's definitely getting more common.
Dec 09Reply
allissat
allissat @petiteshopper happy to help! I just heard about one person's C&D while I was about to start making the keychains and was super confused/worried my bags were illegal lol.
Dec 09Reply
petiteshopper
petiteshopper @allissat I know I wouldn’t want to receive one of those letters! Thanks again for your info👍🏼
Dec 09Reply
petiteshopper
petiteshopper @allissat your bags are lovely! So that’s safe to do since it’s considered art.
Dec 09Reply
petiteshopper
petiteshopper @allissat what about turning Chanel buttons into jewelry?
Dec 09Reply
allissat
allissat @petiteshopper I wouldn't think it's ok...but honestly..more than half the time posh doesn't seem to care so if you had like 3 extra buttons you could probably get away with it. ( not that I would recommend it lol)
Dec 09Reply
allissat
allissat @petiteshopper and technically, if you're just putting buttons on chains you could always just sell the buttons and include a jewelry chain as a free bonus gift.
Dec 09Reply
allissat
allissat I can't afford to have my company/work associated with any law breaking products so I wouldn't take the risk but if you're looking for a way to sell extra buttons you have that could be an option.
Dec 09Reply
petiteshopper
petiteshopper @allissat thanks for the advice. Just asking not going to do it lol

lovetoshop2003 So if I wanted to post a repurposed bag that I bought at a very upscale boutique that is made out of real LV could I?
Oct 24Reply
allissat
allissat @ashleysmith1117 how is the bag 'repurposed'? I see a lot of people using 'repurposed' when its just upcycled and vice versa. You probably have to list it under the boutique name instead of Louis Vuitton, and hope they repurposed it legally.
Oct 24Reply
lovetoshop2003
lovetoshop2003 @allissat it’s from a boutique called Rockwell Tharp. They said they are one of a kind bags. And for the price I paid it should be 😂. It’s leather taken from LV bags (in this case it was the monogram pattern) and make something different. One side is LV leather and the other is real cowhide.
Oct 25Reply
allissat
allissat @ashleysmith1117 so I looked them up and they are definitely selling illegal items. I'm not sure how much you spent/ if its worth trying to get a refund because of the legality of the product. I know you can always get a refund if a product is sold as an authentic item when its not.
Oct 25Reply
allissat
allissat I would try to get a refund because you didn't know they were selling illegal repurposed goods. You might even try contacting LVs legal, see if they can send a letter showing that they didn't have the right to sell it to you?
Oct 25Reply
