Unfortunately, at this juncture, a secondhand sale is not recognised separately. simosclothes @pm_editor_in Can you please clarify if we can still list items as NOT FOR SALE after the 20th of April? Also, the gov takes around a month to provide a GSTIN, wouldn't it make more sense to allow us a month to get this sorted? Poshmark should allow sellers the time it takes to process a GSTIN at least. 2 weeks is clearly too short. Thank you for your answers 🙏

luxuryrehomed @pm_editor_in , registration of GSTIN is not that simple even under the "normal taxpayer" category. It requires a lot of documentation and filling up of information in the https://reg.gst.gov.in/ portal. The least that you can do to help us to provide some guidance/tutorial on the easiest way of doing it considering that we are not really a "business category" but rehomers.

ahumblecloset @pm_editor_in I understand why this is important especially for sellers who have a reasonably large inventory, taxable sale makes sense then. Wondering how this will affect small scale closet sellers like me, and we don't have GST numbers as it's not exactly a typical business for many of us here. I hope it gets easier for us to work these things out

pm_editor_in Dear Poshers, Please note that as of now the listings will be marked NFS for those closets which do not have a GSTIN after 20th April. You can however add a GSTIN after the 20th as well which will immediately reinstate your listings for sale.

ethics_store @pm_editor_in dear poshmark i think 95% of poshers wl exit the platform forcefully because somany of seller must be hourse wife students and employees of private company who are at all not eligible to apply for gstin correct me if i m wrong even tax threshold limit is 3lakh and gstin limit as per current regulations effect from Jan 2023 it's 20lakh of turnover...

If you run a business with an annual turnover that exceeds INR 40 lacs in any states (except special category states) then you will have to register under GST. However, if you are doing business from special category states then the annual turnover limit is INR 20 lacs. In case the annual turnover limit of your business does not exceed the limits specified above you are not required to take registration.

cherrypearl it's a hassle to apply for GST, u have to have a proper business, u hv to hv the board put up, the inspector comes to check if u have proper premises to conduct the business and so on, i had applied for GST a year back coz i wanted to sell on Flipkart some handmade things but it got rejected coz there was no proper business, the board sign was not there they were also very knee to know the premises, they didn't not agree that i would do it from one of the rooms in my house.

preet_13 @myblueumbrella yes it was but GST registration will make me drop this app 🥲🥲 poshmark already had so much through the commission, one doesn't even get all the money but still anyways you get 10 for every 20 for an order, but the only problem here is that when poshmark cuts some additional amount as submission against our pan card or GST/TCS I think then why is it still necessary to register for gst

myblueumbrella @payal6jain i checked again new rule is applicable only for intra state sale that is if i sell to a buyer within state then no need for GST number, poshmark probably should look for a workaround based on the fact that we sell preloved, second hand is not subject to GST as long as no input credit was claimed

Some of us r with poshmark since it started its operation in India. Whole process is arbitrary Gst rules r not clear im not able to find such clause . Defintion of seller doesnt cover one who pass on second hand good

You would agree that in poshmark we have type of sellers 1) preloved stuff sellers 2) shop sellers - who definitely got GSTIN. Now compared to them - we stand no where because online on ecom platform or off they are the ones who are truly satisfying the criteria to have locked in GSTIN.

However - i agree with my fellow poshers here @sehgal29 @simosclothes that we should get a notice of a month. Also - plz look into this GSTIN again from legal pov because as you know some of our posher’s are knowledgeable on such subjects they have reached out to you with proper justification which you might find useful. amreenbeauty @payal6jain hey boo, I get what your tryna say, but i sell most of my NWT items here but that doesn't mean I really own some type of business it's my own collection that I pass on, so the way we can put into this matter is to make the boutique owners a seperate category as they have bulk of selling items and seperate us in preloved/new items category something like that would do, it's unfair to just eliminate NWT items as business and mark them not for sale :(

ethics_store @myblueumbrella exactly dear rule is absolutely clear about 2nd hand selling but i think the one who already has gstin is supporting here without even thinking that if only one or two seller would come up with GST this platform will no longer available for one or two sellers only...this platform is running well just because of number of sellers and buyers...yes but catagory should b there one for fresh products seller and one for used product

myblueumbrella @ethics_store yes GST is only meant for those who actually trade in goods, the tax dept. clearly says that selling of pre-owned items is not a b'ness & if it's not a b'ness then no need for GST, tbh i get two to three orders in a month sometimes more & i sell at a heavy discount, to get some little money & to declutter & i also shop on Poshmark it's consumer to consumer & not a b'ness & pm simply connects consumer to consumer

wearnew_2022 @pm_editor_in most important thing your team is missing. without BIS hallmark how you are allowing to sale so called gold. Consumers interested in buying gold will have to follow a set of new rules from April 1, 2023. The Bureau of India Standards (BIS) will be prohibiting the sale of hallmarked gold jewellery or gold artefacts without a 6-digit alphanumeric Hallmark Unique Identification Number (HUID). so apply this rules. without HUID number seller can't sell gold. it's important .

Please note that the regulation allows sellers without a GSTIN to sell upto the threshold limit only intrastate and not PAN India /interstate. This was a part of the outcomes decided as per the last GST council meeting. We hope this clarifies your query.

Poshmark even dnt know difference between seller and buyer. In poshmark we all were buyer first who paid state taxes to buy those goods which we were passed on in name of preloved we were not even seller and disappointment was that to this platform we gave our best and it has done nothing to save its community.
