Boden size 40 is usually 9. So these run on small side?

@skazdail thank you for pointing out. the marking on one sole is where there was a sticker. I changed description, thank you for pointing it out. I bought at a warehouse sale and I suspect dirty from the store floor. I'm a size 8 and they do fit but we're too big. I looked up sizes online and on the Boden site it links size 40 to 8.5 but perhaps I'm looking at this incorrectly. I will double check.
